You acknowledge agreement with these Terms & Conditions of Sale by the placement of an order to purchase a product from StyleMark UK Ltd, trading as Polaroid Eyewear. In addition, by placing an order on this website you are confirming that you are eighteen years of age or older, you are the same person as named on the credit card used to make the purchase or that you have authorisation from the credit card owner to use such credit card, and that all information you provide is accurate and complete.

2. Governing Law

The Terms and Conditions of Sale and all contracts for the supply of goods and services by StyleMark UK Ltd, trading as Polaroid Eyewear shall be governed by and construed in accordance with English law and the customer submits to non-exclusive jurisdiction of the English courts. All sales shall be deemed made in the UK, regardless of your location as a customer.

3. Purchase Price and Pricing Policy

Prices quoted on the website are inclusive of VAT at the prevailing rate and inclusive of delivery within the UK. Prices are subject to change without notice. While Polaroid Eyewear uses reasonable efforts to include accurate and up-to-date information on this website, Polaroid Eyewear makes no representations or warranties as to its accuracy. Polaroid Eyewear assumes no liability or responsibility for any typographical or other errors or omissions in the content on this site. In the event that a product is listed at an incorrect price or with other incorrect information due to a typographical or other error, Polaroid Eyewear shall have the right to refuse or cancel any orders placed for the product listed incorrectly. Polaroid Eyewear shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and/or your credit card has been charged. If your order has been cancelled, we will notify you by phone or e-mail within 24 business hours. If your credit card has already been charged for the purchase and your order is cancelled, Polaroid Eyewear shall issue a credit to your credit card account in the amount of the charge. If a product offered by Polaroid Eyewear is not as described your sole remedy is to return it to Polaroid Eyewear for a refund.

4. Delivery and Handling Charges

Delivery is free of charge within the UK.

5. Payment Terms

Polaroid Eyewear accepts Visa and MasterCard, as the payment options for your purchase. Your credit card will be charged at the time your order is placed.

6. Promotions

All promotions are subject to availability and inventory. Polaroid Eyewear reserves the right to change, alter or cancel promotions at any time without notice.

7. Product Substitutions

Polaroid Eyewear reserves the right to substitute comparable products of equal or greater value to your original order for out of stock items. In the event we do not have sufficient inventory to ship your order, we will notify you by e-mail or phone. At that time we will provide you with the opportunity to accept the comparable product or cancel the order. You will need to agree to the substitution in writing.

8. Limited Manufacturer’s Warranty

The length of the warranty period varies on Polaroid Eyewear products. All Polaroid Eyewear products are subject to the terms of the warranty that is expressly stated on, packaged with, or accompanies the product. Polaroid Eyewear will replace any product within the warranty period that is defective in manufacture; labelling or packaging provided it is returned to Polaroid Eyewear. Please email uksales@polaroideyewear.com for assistance with product repair or replacement. There are no implied warranties. The warranties of merchantability and fitness for a particular purpose are expressly excluded. Neither Polaroid Eyewear nor its licensors shall be liable in any event for loss of profits, goodwill or other financial loss or special, indirect, incidental, cover, punitive or consequential damages, whether or not foreseeable and even if Polaroid Eyewear has been advised of the possibility of such damages, except in jurisdictions not allowing such exclusions or limitations.

9. Web Orders

Online orders of in-stock products received by 4:00 P.M., Monday – Friday will ship within 24 business hours of receipt. Orders received on holidays or weekends will be processed on the next business day.

10. Order Acknowledgement

Upon receipt of your order you will receive an order acknowledgement via e-mail. Order acknowledgement provides:

• Confirmation of order details
• Total cost of order

11. Deliveries

While Polaroid Eyewear will endeavour to meet quoted delivery times, any period for delivery is estimated and is not a contractual commitment and Polaroid Eyewear shall not be liable for any damages or losses arising out of the delay.

Whilst Polaroid Eyewear takes care to ensure that technical advice given by its employees and agents is accurate and responsible, Polaroid Eyewear shall not be liable for any loss or damage or injury, consequential or other wise, resulting from the acceptance of such advice.

Polaroid Eyewear reserves the right to alter or amend these terms and conditions generally at any time and for any particular class of goods, services or customer.

• In the event any section or portion of a section of these Terms and Conditions of Sale are deemed invalid, illegal or unenforceable, that section or portion of a section shall be stricken from the Terms of Sale, and remaining terms shall continue in full force and effect.
• Polaroid Eyewear shall not be responsible for damages or delays resulting from Acts of God, and from other actions, both governmental and otherwise, including but not limited to war, riot, seizure and embargo.

18. Return Policy

At Polaroid Eyewear, we want you to be completely satisfied every time you shop with us. Occasionally though, we know that you may want to return items. That's why under our 30-day money back guarantee, if for any reason you are unhappy with your purchase, you can return it to us in its original condition within 30 days of the date you received the item.

In addition to your 30-day return guarantee, customers in the European Union are entitled to a statutory cooling-off period of seven working days. This means you have the right to withdraw from the purchase of an item within seven working days of the day after the date the item is delivered.

To cancel the purchase within this seven-working-day cooling-off period, you should note on the delivery slip that accompanies the items giving the reason for the return as "contract cancellation". Package the relevant item(s) securely and send it to us with the delivery slip so that we receive it within seven working days of the day after the date that the item was delivered.

All returns require prior authorisation. Returns must be authorised by Polaroid Eyewear within 30 days of the purchase date. Within 30 days of purchase, Polaroid Eyewear will credit, replace or repair at our sole discretion any product that is returned to us with a Polaroid Eyewear Return Authorisation Number. Please obtain a Return Authorisation number by emailing uksales@polaroideyewear.com. The Return Authorisation number is required for all returns and exchanges.

Please return the product at your expense in an undamaged condition in the original box with all materials and package inserts. Please write the Return Authorisation number on the outside of the package in bold letters. A copy of the original packing slip must accompany the return together with a brief explanation as to why the product is being returned.

Please note that we cannot accept returns if you deliver them to us by hand.

For your protection, we recommend that you use a recorded method of delivery as proof of postage.

Please note that you will be responsible for the costs of returning the items to us unless we delivered the item to you in error, or if the item is damaged or defective. Upon receipt of the returned product to Polaroid Eyewear, a refund will be credited to your account or the product will be repaired or replaced at the sole discretion of Polaroid Eyewear. If a refund is issued it will be for the original purchase price, less the shipping and handling charges.
